Calculating Alimony

Divorce clients appropriately ask about how alimony is calculated.  In Utah, there is no specific formula for alimony as there is for child support.  The most accurate outline for how alimony is determined is the law itself, which can be found by Clicking Here, specifically paragraph (8).  The application of the law to every case is different because, obviously, the facts are different.  Application of your facts to this law is what constitutes legal advice, so you should seek legal advice when you want to determine what alimony you may have to pay or may be able to get.

Generally the courts (and negotiating attorneys and mediators) will look at the standard of living of the parties at the time of divorce and try and equalize income to approximate that standard of living.
